1. Overview

This Refund Policy explains our policy regarding refunds and cancellations for xExo subscriptions operated by ScaleTapp DOOEL ("we," "us," or "our").

Please read this policy carefully before subscribing. By purchasing a subscription, you acknowledge and agree to this Refund Policy.

2. Subscription Model

xExo operates on a monthly recurring subscription basis with the following plans:

Starter Plan: $9/month - 300 AI replies

Pro Plan: $19/month - 1,000 AI replies

Unlimited Plan: $39/month - Unlimited AI replies

Subscriptions automatically renew each month unless cancelled. You have full access to the Service for the duration of your paid billing period.

3. No Refund Policy

IMPORTANT: All subscription fees are non-refundable.

We do not offer refunds or credits for:

  • Partial months of service
  • Unused AI reply quota
  • Subscription downgrades mid-period
  • Cancellations made before the end of a billing period
  • Dissatisfaction with AI-generated content
  • Changes in personal circumstances or needs

4. Why No Refunds?

Our no-refund policy exists because:

  • Immediate Service Delivery: You gain instant access to AI generation capabilities upon payment. Unlike physical products, digital services cannot be "returned" after use.
  • API Costs: Every AI reply generates costs through third-party APIs (OpenAI). These costs are incurred immediately when you use the Service.
  • Subscription Model: You can cancel anytime to prevent future charges. Refunding unused time would undermine the subscription model.
  • Fair Pricing: Our plans are priced competitively to reflect actual usage costs and development expenses.

5. How to Cancel Your Subscription

While we cannot issue refunds, you can cancel your subscription at any time to prevent future charges.

5.1 Cancellation Process

To cancel your subscription:

  1. Visit the Lemon Squeezy Customer Portal (link provided in your subscription confirmation email)
  2. Log in with your email address
  3. Locate your xExo subscription
  4. Click "Cancel Subscription"
  5. Confirm cancellation

Alternatively, email us at f.gajtanovski@gmail.com with the subject "Cancel Subscription" and we will process your cancellation within 24 hours.

5.2 What Happens After Cancellation?

  • Access Retained: You keep full access to the Service until the end of your current billing period
  • No Future Charges: You will not be charged again after the current period expires
  • No Refund: You will NOT receive a refund for the current billing period, even if you cancel immediately after payment
  • Quota Resets: Unused AI reply quota does not carry over and will be lost at the end of the period
  • Data Retention: Your voice profile and account data are retained for 30 days in case you choose to reactivate

6. Exceptions to No-Refund Policy

In rare cases, we may issue refunds at our sole discretion for:

6.1 Service Outages

If the Service experiences a prolonged outage (more than 72 consecutive hours) due to our fault, you may be eligible for a pro-rated credit or refund for the affected period.

Note: Outages caused by third-party services (Twitter/X API, OpenAI, hosting providers) are NOT eligible for refunds.

6.2 Billing Errors

If you are charged incorrectly due to a technical error on our part (e.g., duplicate charges, wrong subscription tier), we will refund the incorrect amount.

6.3 Unauthorized Charges

If your payment method was charged without your authorization, report it immediately to f.gajtanovski@gmail.com. We will investigate and refund if fraud is confirmed.

6.4 How to Request an Exception

To request a refund under exceptional circumstances, email us at f.gajtanovski@gmail.com with:

  • Subject line: "Refund Request - Exception"
  • Your account email address
  • Subscription tier and billing date
  • Detailed explanation of the exceptional circumstance
  • Supporting evidence (screenshots, error logs, etc.)

We will review your request within 5 business days and respond with our decision. Refund decisions are final and made at our sole discretion.

7. Chargebacks and Payment Disputes

Warning: Do not file chargebacks without contacting us first.

If you file a chargeback or payment dispute with your bank/credit card company without first attempting to resolve the issue with us:

  • Your account will be immediately suspended
  • Your access to the Service will be terminated
  • You may be banned from creating future accounts
  • We reserve the right to pursue legal action to recover costs

8. Plan Changes

8.1 Upgrading Your Plan

If you upgrade to a higher-tier plan mid-period:

  • You will be charged the pro-rated difference for the remainder of the current billing period
  • Your new plan's quota takes effect immediately
  • Future billing will reflect the new plan's full price

8.2 Downgrading Your Plan

If you downgrade to a lower-tier plan mid-period:

  • The change takes effect at the start of your next billing period (not immediately)
  • You retain access to your current plan's features until the period ends
  • No refund or credit will be issued for the price difference

9. Free Trial Policy

If we offer a free trial period:

  • You will be charged automatically at the end of the trial unless you cancel before it expires
  • You may cancel anytime during the trial without being charged
  • Once the trial ends and payment is processed, this no-refund policy applies

Set a reminder to cancel before your trial ends if you do not wish to continue.

10. Pricing Changes

We may change subscription prices at any time. If we increase prices:

  • Existing subscribers will receive 30 days' advance notice via email
  • The new price takes effect at your next renewal date
  • You may cancel before the price increase to avoid the new rate
  • No refunds will be issued if you choose not to cancel before the price change
